National Review: Obama and Citizens United

Tonight the president engaged in demogoguery of the worst kind, when he claimed that last week’s Supreme Court decision in Citizens United v. FEC, “open[ed] the floodgates for special interests — including foreign corporations — to spend without limit in our elections. Well I don’t think American elections should be bankrolled by America’s most powerful interests, or worse, by foreign entities.”

The president’s statement is false.


Here’s an argument that Obama is wrong about Foreign Corporations beingallowed to spend over here. First of all, I would define “foreign corporations” to include any corporation that does any business overseas or who has any foreign stockholders. But, the National Review looks at the exact wording and comes to the conclusion he’s wrong…. until the last sentnce.

It is only where a U.S. subsidiary makes a decision without any input whatsoever from its foreign parent that such an act might be protected.

So a foreign corporation could create a US subsidiary with foreign money and employees and that US subsidiary could spend unlimited money. They would jus have to swear that their bosses didn’t give them any input.
